Employing charter schools are required to report allegations of misconduct pursuant to pursuant to California Code of Regulation (CCR) section 80303 and Education Code sections 44420 and 44940 when the educator "holds a position that requires a credential issued by the Commission." When reporting contract abandonment by credential holders, charter schools should identify whether they are organized under the auspices of a public school district.  

Employing charter schools can submit misconduct reports electronically, by selecting the Electronically Submit Misconduct Reports button, below. Please complete the online form and cover letter to include with the submission.  

To submit a misconduct report via US mail, please complete the corresponding notification forms listed below, and include the required documents as directed.

EDUCATION CODE SECTION 44940 requires that a school district report a mandatory leave of absence offense.  Please review ED Code Section 44940 for detailed information regarding this section. 

CALIFORNIA CODE OF REGULATIONS SECTION 80303 requires that school districts report credential holder's change in employment status due to allegations of misconduct.  Please review CCR section 80303 for detailed information regarding this code section. 

EDUCATION CODE SECTION 44420 authorizes a school district to report a credential holder who refuses, without good cause, to fulfill a valid contract of employment.  This section does not apply to independent charter schools not operating under the auspices of a school district.  Please review ED Code Section 44420 for detailed information regarding this section.
